You have 30 calendar days from the agency’s final decision to file with the MSPB. If your case is also eligible for a union grievance, you must choose one forum—MSPB or grievance—not both. If discrimination is involved, it may qualify as a mixed case, giving you the option of filing either a mixed case complaint with the agency or a mixed case appeal with the MSPB. Once you choose a forum, the decision is generally binding. A rejected grievance may still allow an MSPB filing, but only if the 30-day deadline has not expired.
